General Terms and Conditions of Business and Intermediation (GTC)

Important Note: These General Terms and Conditions (GTC) are a translation of the original German version. This translation is provided for the customer's convenience only. In the event of any discrepancy or dispute, the German version shall prevail and German law shall be exclusively applicable, subject to the mandatory consumer protection provisions of the customer's country of residence.

Atlantic Ferienhausvermittlung Owner: Christel Jürgens, Breisgauer Straße 18a, D-14129 Berlin

1. Contracting Parties and Subject Matter

1.1 Atlantic Ferienhausvermittlung (hereinafter "Atlantic") acts exclusively as an intermediary for accommodation services (holiday homes).

1.2 Atlantic is not itself a tour operator or a landlord.

1.3 By submitting a booking request, the customer mandates Atlantic to broker a rental agreement with the respective owner/landlord of the holiday home.

1.4 The rental agreement for the holiday home is concluded exclusively between the customer and the homeowner/landlord named in the rental ID/booking confirmation.

1.5 The provision of the booked service as such is not part of Atlantic's contractual obligations.

2. Payment Processing (Collection)

2.1 Atlantic is authorized by the respective landlord/owner to receive payments on their behalf.

2.2 Upon receipt of the booking confirmation, a down payment of 25% of the rental price is due immediately.

2.3 The remaining balance must be received by Atlantic no later than 21 days (3 weeks) before the start of the rental period.

2.4 Since Atlantic only brokers an individual service, there is no obligation to issue a bankruptcy protection certificate (Sicherungsschein) in accordance with Section 651r of the German Civil Code (BGB).

3. Withdrawal and Cancellation

3.1 Cancellation conditions are based on the provisions of the respective landlord. Unless otherwise stated, the following flat-rate fees apply as reasonable compensation in the event of withdrawal:

  • Up to 90 days before arrival: 5% of the total rental price.
  • 89 to 60 days before arrival: 40% of the total rental price.
  • 59 to 30 days before arrival: 75% of the total rental price.
  • From 29 days before arrival or in case of no-show: 100% of the total rental price.

3.2 Withdrawal must be declared to Atlantic.

3.3 We strongly recommend taking out travel cancellation insurance.

4. Stay, Security Deposit, and Additional Costs

4.1 The conditions on-site (e.g., pets, maximum occupancy) are governed by the brokered rental agreement.

4.2 The holiday home may be occupied by no more than the number of persons specified in the confirmation.

4.3 Any security deposit is collected by the landlord and must be paid in accordance with the terms of the rental agreement.

4.4 Additional services such as final cleaning or bed linen are shown separately in the booking confirmation. If a tourist tax (taxe de séjour) is applicable on-site, it must be paid by the customer additionally on-site, unless it is already included in the booking confirmation.

5. Liability of the Intermediary

5.1 Atlantic is liable exclusively for the proper mediation of the service (consultation, booking processing), not for the provision of the rental service itself or for defects in the rental property.

5.2 Atlantic's liability for damages that are not physical injuries or damage to health is limited to three times the value of the brokered service, provided the damage was not caused intentionally or through gross negligence.

6. Notification of Defects

6.1 Since the rental agreement exists directly with the owner, defects in the property must be reported to the owner or their local representative immediately. Insofar as Atlantic acts as the local representative of the owner on-site (e.g., during key handover), the notification of defects is to be addressed directly to Atlantic.

6.2 In this case, Atlantic will provide assistance within the scope of the authority and possibilities granted by the owner. However, a legal obligation to remedy defects only applies to Atlantic insofar as this exists within the scope of the power of attorney granted by the owner; primary liability for the condition of the rental property remains with the owner.

7. Data Protection

7.1 We process your data for the fulfillment of the mediation mandate.

8. Dispute Resolution and Choice of Law

8.1 Atlantic does not participate in voluntary dispute resolution proceedings before a consumer arbitration board.

8.2 German law applies to the mediation relationship between the customer and Atlantic.
