1. Conclusion of contract
1.1 Atlantic rents out the holiday properties it offers in its own name and for its own account.
1.2 By submitting a booking request, the customer makes an offer. The contract is concluded upon Atlantic's booking confirmation. The booking confirmation is decisive for the content of the contract.
1.3 Atlantic engages the owners and independent local service providers to perform the contract. They are not authorised to make declarations binding on Atlantic.
2. Price and payment
2.1 25% of the rental price is due upon receipt of the booking confirmation; the balance no later than 21 days before arrival.
2.2 The rental price is a final price and is payable to Atlantic. Which ancillary costs and charges are included is set out in the booking confirmation.
2.3 If the customer fails to pay on time, Atlantic may withdraw from the contract after an unsuccessful reminder with a reasonable deadline and settle the account in accordance with clause 3.2.
3. Cancellation by the customer
3.1 The customer may cancel at any time before arrival. Cancellation must be declared to Atlantic; receipt is decisive.
3.2 In the event of cancellation or no-show, the following compensation is payable, based on the rental price:
● up to 90 days before arrival: 5%
● 89 to 60 days before arrival: 40%
● 59 to 30 days before arrival: 75%
● from 29 days before arrival or in the event of no-show: 100%
The customer remains entitled to prove that no damage or substantially less damage has occurred.
3.3 Taking out travel cancellation insurance is recommended.
4. Stay
4.1 The property may only be occupied by the number of persons stated in the booking confirmation; children count as persons. In the event of overoccupancy, Atlantic may refuse access or demand a reasonable additional payment.
4.2 Arrival and departure times and any security deposit are set out in the booking confirmation. The deposit will be settled after the property has been returned.
4.3 The customer is liable for damage caused by the customer or by fellow travellers.
5. Defects
5.1 Defects must be reported without delay to the contact point named in the travel documents so that a remedy can be provided.
5.2 If the customer culpably fails to report a defect, claims that could have been avoided by timely notification shall lapse.
6. Liability
6.1 Atlantic is liable in accordance with statutory provisions for injury to life, body or health and in cases of intent and gross negligence.
6.2 In the event of a slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical of the contract. Otherwise liability is excluded.
7. Data protection
Atlantic processes personal data for the performance of the contract. Details are governed by the privacy policy.
8. Final provisions
8.1 German law applies. Mandatory consumer protection provisions of the state in which the customer has his or her habitual residence remain unaffected.
8.2 Atlantic does not participate in dispute resolution proceedings before a consumer arbitration board.
8.3 These terms and conditions were drawn up in German. Versions in other languages are translations; in the event of discrepancies, the German version prevails.
